Unnao Rape Verdict: Sengar’s Fall from Power to Prison

On August 1, 2019, the Supreme Court transferred the trial to itself through a Suo Motu Writ Petition (Criminal) alongside a Transfer Petition.

The Supreme Court directed authorities to ensure the safety and security of the survivor and her family members. Consequently, the appellant received a life sentence under Section 376 (rape) of the IPC, 1860, as well as the POCSO Act for assaulting the minor. In addition, the State of Uttar Pradesh paid an interim compensation of Rs. 25,00,000 to the survivor’s mother.

Kuldeep Singh Sengar who was in prison after surrendering, requested an interim suspension of his sentence for 30 days due to medical reasons. In response, the Delhi High Court granted him one day of interim bail under specific conditions.

The appellant must provide a personal bond of Rs. 50,000 along with one surety of the same amount. This must satisfy the concerned Jail Superintendent. The following conditions must also be complied with by the appellant:

  1. The appellant shall not leave his residence except for visiting AIIMS.
  2. The appellant shall undergo cataract surgery on 24 January, 2025.
  3. If for any reason, the surgery cannot be conducted on 24 January, 2025, the appellant shall surrender to the Jail Superintendent.
  4. The appellant, while admitted, shall not be permitted to have more than two visitors at a time.
  5. CBI shall be in touch with the appellant on a daily basis.

The application was disposed of in the above mentioned terms.
